General Terms and Conditions

PREAMBLE

This website (a project of BLEGH GmbH hereinafter also referred to as the “Operator”) offers the possibility of obtaining a personal member account via its Internet presence by registering for a fee. This account is used to participate in webinars and to access the recordings of these webinars at a later date.
The following GTC govern the contractual relationship between the Operator and the natural persons and legal entities (hereinafter “Users”) who use the platform. The version of the GTC valid at the time of the conclusion of the contract is authoritative.

SCOPE OF APPLICATION AND CHANGES TO THE TERMS OF USE

These General Terms and Conditions (hereinafter referred to as “Terms and Conditions”) apply to all registrations made and contracts concluded via the websites of BLEGH GmbH, via e-mail.
These terms and conditions apply exclusively; we do not recognize terms and conditions that conflict with or deviate from these terms and conditions.
The scope of these terms and conditions covers the entire platform of this website, including all areas integrated therein and those to be integrated in the future.
The operator is entitled to change and/or amend these terms and conditions with a reasonable period of notice. The change will be communicated to the users by email. If a User does not object to the GTC within 2 weeks after receipt of the eMail to the User, the new GTC shall become effective. If the User objects in due time, the Operator is entitled to terminate the contract in due time.

PAID REGISTRATION

A paid registration is required for the active use of the further education offers. If the operator accepts the user’s registration request, a contract of use against payment is concluded between the respective registered user and the operator. The user is not permitted to transfer the user contract to a third party.
There is no legal claim to registration.
Eine Registrierung kann jede natürliche Person durch das Buchen der Einzelbuchung bzw. auf der Plattform beantragen, die mindestens das 18. Lebensjahr vollendet hat und diesen Bedingungen zustimmt.
Any natural person can apply for registration by booking the individual booking or on the platform, who is at least 18 years of age and agrees to these terms and conditions.
Registration requires the entry of a valid email address, a user name and password, as well as billing information and bank account details. Users undertake to provide correct and complete information within the scope of their registration and, in particular, not to infringe the rights of third parties. A violation of the rights of third parties is given, among other things, if personal information or other data of third parties are used without their consent, e.g. the name or e-mail address.
Users are obliged to keep the password chosen during registration secret and not to pass it on to third parties. Each registered user is obliged to inform the Operator immediately in case of loss or unauthorized use of his/her access information. The Operator will not make the password chosen during the registration of a member account available to third parties and will not ask for the disclosure of the password either by telephone or e-mail or via the internal communication channels.
The registered users are responsible for the confidential treatment of the access information (especially the password) given to them or chosen by them and are liable to the Operator for damages caused by culpable violation of these duties of care.
By clicking the “Book Now” button, the User bindingly declares that he/she wishes to conclude a contract for the selected paid registration. The operator is entitled to refuse acceptance of the booking – for example, after checking the creditworthiness of the user.
As a further education measure, the offer is exempt from VAT.
The operator is free to send invoices and payment reminders only electronically.
The Operator reserves the right to change the billing from Euro to the User’s respective national currency at any time, provided the User does not object to this.
The Operator is entitled to delete the User and block the User in the event that the User has provided untrue, inaccurate or incomplete registration data, which may lead to incorrect individualization of the User.
The User’s claim for reimbursement of fees already paid in advance in the event of termination is excluded.

SUBJECT MATTER OF THE CONTRACT & EXECUTION

The subject matter of this agreement is the provision of continuing education offerings and the granting of rights of use to the offerings.
The offers are made available in the form of live webinars as well as recorded videos, which are carried out via the edudip platform (see also further information in the data protection section). The live events are recorded and made available as videos afterwards. The participants are not included in these recordings.

FORCE MAJEURE

Neither of the parties shall be obliged to fulfill the contractual obligations in case of and for the duration of force majeure. In particular, the following circumstances shall be considered as force majeure in this sense:
– fire/explosion/flood for which the Operator is not responsible.
– war, mutiny, blockade, embargo
– industrial dispute lasting more than 6 weeks and not culpably caused by the contractual partner
– technical problems of the internet which cannot be influenced by the operator or one of its contractual partners.
Each contracting party shall immediately notify the other in writing of the occurrence of a case of force majeure.

EXCLUSION

BLEGH GmbH reserves the right to exclude participants from a webinar. In the following cases, the full course fee is owed, i.e. there will be neither a proportional refund nor a waiver of the course fee: Course exclusion due to non-payment of the course fee as well as in serious cases (defamation, harassment, etc.).

DATA PROTECTION

The processing of personal data by BLEGH GmbH is carried out in accordance with the provisions of the Data Protection Act. By registering, the student agrees that the BLEGH GmbH may store and use the data (personal data, courses booked, payment history, etc.) for administration, marketing, advertising, etc.

PROGRAM, PRICE AND GENERAL TERMS AND CONDITIONS CHANGES

BLEGH GmbH reserves the right to change the program, the prices and the GTC at any time. The version valid at the time of registration is decisive in each case, which cannot be changed unilaterally for this contract conclusion.

SIDE AGREEMENTS

Amendments to the contract and subsidiary agreements must be made in writing to be effective.

SEVERABILITY CLAUSE

Should any provision of this contract be or become invalid, this shall not affect the legal validity of the remaining provisions. The contracting parties undertake to replace the invalid provision with a valid provision whose purpose comes as close as possible to that of the omitted provision, unless the invalid provision serves the protection of an individual. Place of performance and jurisdiction is at the registered office of BLEGH GmbH. Swiss law applies with the complete exclusion of the conflict of laws as well as the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980.
